The legislative process is now fully underway: the deadline to file most bills was Friday, March 08, at 6:00 p.m. As of this writing, approximately 5300 bills have been filed by both the House and Senate. Bills are being referred out of committee, and it is expected that the House will begin debating its first bills on the floor sometime next week. This week, I will discuss a few of the bills filed by other legislators that have been passed out of committee and could be taken up by the full House sometime soon.
It has been reported that some unscrupulous auto repair shops have been using counterfeit airbags as replacement parts for vehicles involved in accidents. In many cases, these counterfeit airbags were shown to malfunction and pose a high risk of bodily injury or even death to passengers in the vehicle. House Bill 38 would increase the penalty from a Class A misdemeanor to a state jail felony for the following offenses: knowingly installing a counterfeit airbag; purporting to install an airbag and failing to do so; making or selling a counterfeit airbag to be installed in a motor vehicle; intentionally altering an airbag that is not counterfeit in a manner that causes the airbag to not meet all applicable federal safety regulations for an airbag; representing to another person that a counterfeit airbag installed in a motor vehicle is not counterfeit; or causing another person to commit such a violation or assisting a person in such a violation. The bill enhances the penalty for such an offense to a felony of the first degree if it is shown at trial that the offense resulted in the death of a person. In recent years, the recreational and ecological value of Texas lakes has been threatened by harmful invasive aquatic species, such as the zebra mussel at Lake Texoma. In light of the potentially devastating nature of invasive aquatic species, it is important to educate the public on means of preventing exotic harmful aquatic species from penetrating lakes currently unaffected by such species. House Bill 597 would require a boater education course or to include information on how to prevent the spread of exotic harmful or potentially harmful aquatic plants, fish, and shellfish, including methods approved by the Parks and Wildlife Department for cleaning a boat, a boat's motor, fishing and other equipment, and a boat trailer.
